Prices

All prices are subject to change without notice. Feel free to call, fax, e-mail or write to our sales personnel for current pricing information. All prices are FOB WILDFIRE’s warehouse/shipping point unless specifically quoted otherwise.

Minimum Charge

We will be pleased to accept all orders. Due to the cost of handling an order, a $15.00 service charge, plus any applicable taxes and/or transportation charges, will apply to all orders of less than $100.00.

The minimum order will be waived if merchandise is purchased on Visa.

Payment Terms

Net 30 days, subject to credit approval. Past due amounts are subject to late payment charge of 1.5% per 30 days, or service charge at the maximum rate allowed by applicable state law. Charges incurred in the collection of invoices owed will be the sole responsibility of the buyer.

Delivery

We constantly strive to maintain an extensive inventory to service your needs. Every effort will be made to ship in a timely manner. Notwithstanding anything to the contrary set forth in any purchase order or distributor agreement, passage of title and risk of loss will transfer to the buyer from Wildfire Group upon shipment from any designated Wildfire warehouse or supplier location, unless otherwise specifically agreed upon by Wildfire and the buyer in writing. Shipments will be made freight prepaid with shipping and freight charges added to the invoice unless buyer freight account number is provided. Seller may make partial shipments and each shipment may be treated separately for purposes of invoicing. The Seller's count and weights taken at the shipping points govern. Delivery schedules are approximate and not guaranteed.

Shortages or Damaged Merchandise

Any shortage, damage or error in shipment should be reported to us immediately upon receipt of good and at the latest within 10 days after delivery. All packages should be carefully inspected for visible damage prior to acceptance from the transportation company and delivery refused or damage noted when signing for receipt of packages.

Returned Goods

Please contact our customer service department will full details concerning the return of any goods and the issuance of a Return Goods Authorization number (RGA). Material returned for reasons other than defective replacement will carry a minimum 20% handling and restocking charge. Material must be in new and original condition subject to inspection, and returned freight prepaid.

Note: Non-stock items purchased on special order are to be considered non-cancelable and non-returnable.

Consequential Damages

Some states do not allow the exclusion or limitation of incidental or consequential damages, so the above limitations may not apply to you. This warranty gives you specific legal rights, and you may have other rights, which vary from state to state.

Wildfire guarantees all merchandise manufactured by Wildfire to be free from defects in material and/or workmanship for a period of one (1) year from date of invoice. Any item believed to contain a defect must be returned to Wildfire for examination and evaluation. Buyer shall pay transportation charges. If merchandise is defective, Wildfire will repair or replace the defective item and reimburse buyer for transportation charges to and from Wildfire.

Limitation of Liability

THE WARRANTY SPECIFIED HEREIN IS LIEU OF ANY AND ALL OTHER WARRANTIES, EXPRESSED, OR IMPLIED. Wildfire herby disclaims any implied warranties of merchantability or of fitness for any particular purpose.

Wildfire’s liability on any claim of any kind, including negligence, for any damage or loss including but not limited to personal injury or consequential damage arising out of, connected with or resulting from this contract, or from the manufacture, lease, sale, delivery, resale, return, repair, maintenance, handling or use of any item covered by or furnished under this sale, shall in no case exceed the purchase price. Wildfire shall not be liable for any penalty or for any special, indirect or consequential damages.
